Who Qualifies for Services Under Section 504?
A student who has a physical or mental impairment which substantially limits one or more major life activities.

Substantial Limitation
The criteria for substantial limitation asks whether, when compared to the child’s peer group, the child functions in a way that the average child performs. Except for eye glasses or contact lens, mitigating measures such as medication may not be considered in determining Section 504 eligibility.

Major Life Activities

Caring for oneself, hearing, walking, seeing, performing manual tasks, speaking, breathing, learning, reading, concentrating, thinking, communicating, working, as well as major bodily functions.

Medical conditions such as diabetes, allergies, and cancer may be Section 504 considerations. The chronicity of the medical condition and complexity of the modification and accommodations drive the need for Section 504 eligibility.

What is Section 504?
Section 504 refers to a part of the Rehabilitation Act of 1973. Section 504 is a civil rights law that prohibits discrimination on the basis of "disability" in programs and activities that receive federal financial assistance from the U.S. Department of Education.
